Capital Jobs provides no warranty that the services provided by its website will
be uninterrupted or error-free. Capital Jobs does not guarantee that files provided

or other destructive code. Users are responsible for implementing sufficient measures

Right to use information provided to us
You agree that Capital Jobs may reproduce, distribute and publicly display information
that you submit to us via email or other means.
No guarantees about security of information
While Capital Jobs takes due care to ensure that users’ personal information remains
private, the possibility exists that the information could be unlawfully observed
by a third party while in transit over the internet or while stored on Capital Jobs
systems or the website. Capital Jobs will not be held liable should this occur.
Login Credentials
As a user of the Capital Jobs website, you are invited to become a registered Job
Seeker. As a registered Job Seeker, you must specify a username and password. Your
username and password is to remain confidential. You are entirely responsible if
you do not maintain the confidentiality of your login details. Additionally, you
will be held responsible for any activity that is undertaken using your login credentials.
You agree to notify Capital Jobs of any unauthorised access to your login or any
other security breach. You may change your password or delete your registration
at any time.
No misrepresentations
You agree not to make any false representations that seek to mislead or deceive
others (eg. When applying for vacancies or uploading your CV).
Applicable law
The laws governing this agreement will be the laws in the Australian Capital Territory,
Australia. You irrevocably submit to the exclusive jurisdiction of its courts and
the jurisdiction of the Federal Court of Australia.

Job slots and CV views
In order to find job seekers on the Capital Jobs website, advertisers agree to purchase
advertising ‘packs’ containing a number of job slots and CV views.
Job Slots. Job slots enable the advertiser to post job advertisements on
the website in relevant categories. A single job slot enables the advertiser to
advertise one job at a time, for a period of at least thirty days (depending upon
the duration of the ‘pack’ purchased) – that is, advertisers may choose to advertise
multiple jobs during the life of the job slot, but only one advertisement can show
in that slot at any one time. Advertisers will not be permitted to post advertisements
to the website if their job slot allocation has been exhausted. Advertisers can
easily purchase further ‘packs’ which will provide them with further slots. The
advertiser is responsible for managing their job slot allocation and managing which
advertisements appear in those slots.
CV Views. Advertisers are also granted a number of CV views per day as part
of their advertising ‘pack’. Advertisers have the opportunity to search the Capital
Jobs job seeker database for prospective candidates and view their CV details on
request. Again, advertisers can easily purchase further ‘packs’ which will provide
them with more CV views per day, if required. Advertisers are to use the CV and
other job seeker information to match against their organisation’s current vacancies.
This information is not to be used for any other purpose.
Payment, Refunds and Credit Checks
All monies owed to Capital Jobs by advertisers are to be paid within 7 business
days of invoice. Fees are not refundable once payment has been made, unless in situations
where a technical issue precludes the posting of advertisements.
Capital Jobs reserves the right to remove existing advertisements, disable advertiser
accounts without notice, or ban advertisers from future use of the Capital Jobs
site, if payment is not made within the required period.
Capital Jobs reserves the right to obtain credit information about the advertiser
from a credit reporting agency or other credit provider.
Compliance with relevant legislation
Advertisers must comply with the Human Rights and Equal Opportunity Commission Act
1986 (Cth) and all anti-discrimination and equal opportunity legislation applicable
in the State or Territory in which they conduct business. Advertisers agree to deal
with any information accessed from the website in a manner which abides by all applicable
laws of Australia, including privacy (Privacy Act 1988 (Cth) and the National Privacy
Principles) and copyright laws. Advertisers agree to abide by the Trade Practices
Act 1974 (Cth) and Fair Trading Acts in all applicable States and Territories.
No guarantees about job seeker representations
Advertisers agree that the Capital Jobs website offers a channel through which individuals
can search and apply for job opportunities, and understand that the quality of applicants
is not tested by Capital Jobs. Capital Jobs does not vet individual applicants and
cannot be held liable for any loss sustained as a result of an Advertiser employing
a job seeker via the website.
Responsibility for advertisements and other content
Capital Jobs accepts no responsibility or liability for errors in job advertisements
or other content on the website. Advertisers are required to check their advertisements
for errors prior to and after posting on the website. Advertisers acknowledge that
Capital Jobs does not routinely vet advertisements posted to the website. The advertiser
remains responsible for all advertisements that are displayed on the website at
any given time.
Restrictions on content
1. Advertisers may not advertise get-rich programs, pyramid schemes or require a
job seeker - either expressly in the advertisement or subsequently - to pay any
fee or charge to apply for any job on the website.
2. Advertisers may not advertise more than one vacancy per job advertisement.
3. Advertisers may only advertise jobs in relevant job categories on the website.
4. Advertisements are to be written in English.
5. Advertisements are to be free of spelling and grammatical errors and must not
contain slang words or unsavoury language.
6. Advertisements for adult services are not permitted.
Removal of advertisements
Capital Jobs reserves the right to reject, remove or reclassify any advertisement
on the website, without notice, for any reason that it deems appropriate.
Unsolicited email
Advertisers may not use the website to send unsolicited commercial email to job
seekers. Email addresses may only be used to communicate with job seekers about
the specific vacancy to which they have applied. The CV database may only be used
to communicate with job seekers about specific vacancies that match their job preferences.
Security
Advertisers must keep their account password details confidential. Capital Jobs
will not be held responsible for any unauthorised access to the Advertiser’s online
account. Capital Jobs recommends that advertisers use the multiple user accounts
facility, rather than operating from a single master account.
Termination of accounts
Capital Jobs reserves the right to reject or terminate any advertiser account, without
notice, for any reason that it deems appropriate.
No guarantee of service
Capital Jobs provides no warranty that the services provided by its website will
be uninterrupted or error-free. Capital Jobs does not guarantee that files provided
for downloading through the site or via email will be free from infection by virus
or other destructive code. Users are responsible for implementing sufficient measures

Functionality
Capital Jobs reserves the right to alter the functionality and appearance of the
website, and the ranking of job advertisements, without notice to advertisers.
Warranties
The advertiser warrants that it has the legal capacity and power to enter into this
agreement and to perform obligations specified herein. The advertiser warrants that
advertisements and other content posted on the website do not breach the intellectual
property rights of any third party. The advertiser warrants that all files delivered
to Capital Jobs will be free of infection or viruses. The advertiser warrants that
it will not use the website for any illegal purpose.
Indemnification
Advertisers indemnify Capital Jobs, its officers, employees and agents against all
claims, actions, suits, damages and expenses incurred by Capital Jobs in connection
with a breach of this agreement, any negligent act or omission by the advertiser,
or the listing of any advertisement on the website.
Applicable law
The laws governing this agreement will be the laws in the Australian Capital Territory,
Australia. Advertisers irrevocably submit to the exclusive jurisdiction of its courts
and the jurisdiction of the Federal Court of Australia.
